1. Acceptance of Terms
By accessing or using the website located at www.omiwaa.com (the “Site”) and any services offered by OMIWAA LLC (“OMIWAA”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Site or services.
These Terms apply to all visitors, buyers, sellers, and any other users of the Site.

OMIWAA LLC is a limited liability company (LLC) incorporated in the State of Wyoming, United States. As is common for US-registered LLCs, our registered agent address is 30 N Gould St, Ste N, Sheridan, WY 82801, USA.
OMIWAA operates internationally, with equipment sourcing, inspection, and fulfillment managed from facilities in both the United States and Europe. This dual-location model allows us to serve customers worldwide with faster shipping times and broader inventory access.

3. Products & Equipment Condition
3.1 As-Is Sales
All equipment sold by OMIWAA LLC is sold “as-is” and “as available.” Unless expressly stated otherwise in the product listing, no manufacturer warranty is transferred or implied. OMIWAA does not provide any warranty, express or implied, including warranties of merchantability or fitness for a particular purpose.
Notwithstanding the foregoing, OMIWAA LLC stands behind the accuracy of its condition grades and listing descriptions. Please refer to our Refund & Return Policy for applicable remedies in the event of a material discrepancy between the item received and its listing description.
3.2 Product Descriptions
We make every effort to accurately describe the condition, specifications, and included accessories of each item. However, used equipment may show signs of wear consistent with professional use. Product images are for illustrative purposes and may not reflect the exact unit shipped.
3.3 Inspection
All equipment listed on our Site has been inspected and tested by our team prior to listing. Inspection reports or condition grades may be available upon request for specific items.
4. Ordering & Payment
4.1 Order Acceptance
Placing an order on our Site constitutes an offer to purchase. OMIWAA reserves the right to accept or decline any order at its sole discretion. An order is confirmed only upon receipt of a written confirmation from OMIWAA.
4.2 Accepted Payment Methods
We currently accept the following payment methods:

Payment must be received in full before shipment is initiated, unless a prior written agreement has been established.
4.3 Pricing
All prices are listed in US Dollars (USD) and are subject to change without notice. All orders include free shipping. Applicable taxes and customs duties are not included and remain the responsibility of the buyer, as indicated at checkout.
5. Shipping & Delivery
OMIWAA LLC ships worldwide with free shipping on all orders. Each product listing specifies the dispatch warehouse (United States or Europe).

Shipped from the United States:
- USA & Canada: 1–3 business days
- Europe: 5–8 business days
- Rest of World: 7–12 business days
Shipped from Europe:
- Europe: 2–4 business days
- USA & Canada: 5–8 business days
- Rest of World: 7–12 business days
Delivery times are estimates and may vary depending on customs clearance, carrier conditions, or events outside our control. Tracking information will be provided once the shipment is dispatched. Risk of loss and title pass to the buyer upon delivery to the carrier.
6. Returns & Refunds
6.1 Return Eligibility
OMIWAA accepts returns within 30 days of delivery for both defective and non-defective items, subject to the following conditions:
- The return request is submitted in writing to contact@omiwaa.com within 30 days of the delivery date.
- The item is returned in its original condition, with all included accessories and original packaging where available.
- The item has not been damaged or modified by the buyer after delivery.

6.2 Restocking Fee
A restocking fee of 15% of the product price applies to non-defective returns (buyer’s remorse, change of mind). No restocking fee applies when the return is due to our error (wrong item, undisclosed defect, item not matching listing description).
6.3 Non-Eligible Returns
The following situations do not qualify for a return:
- Items returned without prior written authorization from OMIWAA (no RA number).
- Damage caused by the buyer after delivery (mishandling, improper use, or unauthorized modifications).
- Items explicitly sold as “for parts” or “non-functional” in the original listing.
- International orders where customs duties or import fees were refused, resulting in the package being returned or destroyed.
6.4 Return Process
To initiate a return, contact us at contact@omiwaa.com with your order number, a description of the reason for return, and supporting photographs if applicable. Upon approval, we will provide return shipping instructions and a Return Authorization (RA) number.
Return shipping costs are the responsibility of the buyer for non-defective returns. OMIWAA covers return shipping costs when the return is due to our error.
6.5 Refunds
Approved refunds will be processed within 5 to 10 business days of receiving and inspecting the returned item. Refunds will be issued via the original payment method. For non-defective returns, the 15% restocking fee will be deducted from the refund amount.
7. Equipment Buy-Back Program
OMIWAA LLC also purchases surplus and used professional equipment. If you wish to sell your equipment, you may submit a request via our website or by contacting us directly. Any offer made by OMIWAA is non-binding until a written purchase agreement is signed by both parties. OMIWAA reserves the right to decline any purchase offer at its discretion.
8. Intellectual Property
All content on this Site, including text, graphics, logos, product images, and software, is the property of OMIWAA LLC or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from this Site without our express written permission.
Brand names and logos displayed on this Site (e.g., Fluke, EXFO, Fujikura, VIAVI) remain the intellectual property of their respective owners. Their display does not imply endorsement of OMIWAA by these brands.
9. Limitation of Liability
To the maximum extent permitted by applicable law, OMIWAA LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site or purchase of products, even if OMIWAA has been advised of the possibility of such damages.
Our total liability to you for any claim arising from a purchase shall not exceed the purchase price of the item giving rise to the claim.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Sheridan County, Wyoming.
11. Changes to These Terms
OMIWAA LLC reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
